The collision

Run the beard-plucking through the five factors and it collapses immediately. Object: none — Bhṛgu was not aiming at anyone, he was enjoying a moment. Effort: he stroked his beard. Accomplishment: there is nothing to complete. On the tradition's own analytics these men generated almost no binding karma at all, and the volume that contains the analytics has them mutilated at the site of the gesture.

So there are two sentencing systems in one corpus and they measure different things. One measures what was in you — intention, stain, the exhale of done. The other measures what was visible and answers it in kind.

And here is what makes it a collision rather than an inconsistency: the visible-gesture system is far more legible than the karmic one. You can see the beard come off and you can say why. Nobody can see a kleśa. The scene is not a lapse into crude retribution — it is the only sentencing in the volume that a spectator could reconstruct from the outside without being told anything. The system with no interior access is the one that produces a public record.

The Arthaśāstra comparison sharpens it from a third direction. Kauṭilya's whole treatment of the rod is a dial — severe, mild, calibrated — and the dial has one axis. The shape of the punishment is not a variable he considers. Which means the isomorphism between offence and sentence is doing something that magnitude cannot do, and neither the Purāṇa nor the political manual ever names it.

Candidate idea

Punishment shaped like the offence is not a theory of desert. It is a communication protocol — it prices the act in a currency the audience can read without access to the offender's mind.

Symbolic retribution survives in systems that otherwise know better, and this is why: it converts a judgement about an invisible interior into a statement about a visible exterior. Everyone in the arena watched Bhṛgu stroke his beard. Everyone can now see him without it. No inference is required and no authority has to be trusted.

Which produces the testable general claim: wherever a sentencing regime has a rich theory of interior culpability and still reaches for offence-shaped punishment, the offence-shaped punishment is being aimed at witnesses rather than at the offender. Look for it wherever a verdict must persuade people who were not present at the deliberation — publicised sackings, sanctions designed to mirror the misconduct, the shape of a public apology.

What would need to be true
  • A second instance in this corpus. There is exactly one triple here — three sentences in one scene — so the pattern is `[n=1 SCENE, three instances inside it]` and must not be reported as a corpus-level regularity.
  • The counter-case that would break the audience reading: an offence-shaped punishment administered with no witnesses. If those are common, the protocol account is wrong and something closer to sympathetic magic is doing the work.
  • Whether the vault's behavioural-mechanics corpus already holds the modern form — the giveaway humiliation ritual is the nearest thing on disk, and it is about status transfer rather than sentencing, so it is an adjacent shape and not a confirmation.
